The Uniform Conditions of Stayokay are derived from the uniform conditions governing all agreements reached and lodgings and meal services provided by hotels, restaurants and cafés, as well as associated companies established in the Netherlands. The Uniform Conditions of Stayokay are registered at the Amsterdam Chamber of Commerce.

To the exclusion of all other or general conditions, the Uniform Conditions of Stayokay apply to the establishment and content of all agreements, as well as all special offers or quotations and requests for reservations arising as a result of the establishment of such agreements. The applicability of general or other conditions of the customer and/or guest or of general or other conditions referred to by the customer, are expressly set aside by Stayokay. If further general conditions nonetheless apply, the Uniform Conditions of Stayokay will prevail in cases of potential conflict.
All offers made by Stayokay or on behalf of the Hostel with respect to the establishment of an agreement are non-binding and take place on the deferred condition ‘that there are sufficient stocks and/or capacity to honour the reservation’. If, on behalf of Stayokay, the Hostel should seek recourse in accordance with the deferred condition within a reasonable period as circumstances may require following acceptance by the customer, the agreement will be deemed null and void.
If, on behalf of Stayokay, the Hostel has awarded the customer an option, this option may not be revoked, except if and to the extent that another potential customer makes the Hostel an offer to establish an agreement pertaining to the services outstanding under the option in whole or in part.
Without prejudice to that stated hereinafter, Stayokay is obligated in accordance with the agreement to provide the agreed services at the agreed times by the Hostel in the manner such is usually provided by the Hostel concerned.
This obligation does not apply:
- under circumstances beyond the control of Stayokay as intended in Article 12;
- if the guest does not arrive at all or arrives more than half an hour after the agreed time on the agreed date;
- if the customer fails to transfer the deposit/interim payment intended in Article 7 on time;
- if the customer fails to submit a turnover guarantee within the period stipulated by Stayokay, despite an explicit request to this effect;
- if the customer fails in any other way to completely fulfil his/her obligations vis-à-vis Stayokay arising in whatever manner.
The Hostel is not bound to take into receipt and/or possession for safekeeping any goods belonging to the guest. Pets are not permitted at the Hostels, with the exception of guide dogs for the blind..
The house rules will be clearly displayed, presented or made available for perusal for all guests within the Hostel, or they will be presented in writing to the guests. Guests are expected to comply with the house rules.
Stayokay reserves the right within the Hostel and at all times without prior notification to refrain from providing services to a guest, if the guest contravenes one or more house rules, whether repeatedly or not, or behaves in such a manner as to disrupt order and tranquillity within the Hostel in any way whatsoever and/or in such a way as to interrupt or potentially interrupt its normal operations.
Stayokay reserves the right to allocate the guest and/or customer alternative (conference) space and/or rooms and/or areas within or belonging to the Hostel than should be allocated in terms of the established agreement, unless such a request would clearly be perceived by the guest as unreasonable and obviously unacceptable. In such a case, the guest and/or customer has the right to immediately terminate the agreement to which the aforementioned wish of Stayokay applies, without prejudice to his/her obligations arising from any other agreement. If, based on the foregoing, through offering alternative (conference) space and/or rooms and/or areas within or belonging to the Hostel than should be allocated in terms of the established agreement, Stayokay should save expenses, the guest and/or customer has a right to said savings. For the rest, Stayokay may never be held liable for damages in any way whatsoever.
The customer and/or guest is not authorized to cancel an agreement, unless he/she simultaneously and irrevocably offers to pay the amounts determined hereinafter. Each cancellation will be deemed to include such an offer. Such an offer will be deemed to have been accepted if, on behalf of Stayokay, the Hostel does not immediately reject the offer. Cancellations must be made in writing, by e-mail, letter and/or fax and they must be dated. The customer can derive no rights on the basis of a verbal cancellation.
In the case of a no-show, the customer and/or guest will in all instances be obligated to pay the reservation price.
If not all of the agreed (conference) spaces, rooms and/or areas and/or meals are cancelled, the provisions below apply to the cancelled (conference) spaces, rooms and/or areas and/or meals proportionately.
If a reservation is made for a group (11 or more persons), the following applies with respect to the cancellation of said reservation:
- For cancellation more than 3 months prior to the date on which, according to the agreement, the first service was to have been provided, to be referred to hereinafter as ‘the commencement date’, the customer will not be required to pay Stayokay any form of compensation.
- For cancellation more than 2 months prior to the commencement date, the customer will be required to pay Stayokay 15% of the reservation price.
- For cancellation more than 1 month prior to the commencement date, the customer will be required to pay Stayokay 35% of the reservation price.
- For cancellation more than 14 days prior to the commencement date, the customer will be required to pay Stayokay 60% of the reservation price.
- For cancellation more than 7 days prior to the commencement date, the customer will be required to pay Stayokay 85% of the reservation price.
- For cancellation 7 days or less prior to the commencement date, the customer will be required to pay Stayokay 100% of the reservation price.
If a reservation is made for one or more individuals, the following applies with respect to the cancellation of said reservation:
- If the cancellation is made before 3 p.m. on the day before arrival, the guest is not obliged to pay anything to Stayokay.
- For cancellation after 3 p.m. on the day before arrival, the guest will be required to pay Stayokay 100% of the reservation price.
- If the cancellation concerns a non-refundable booking, the guest is obliged to pay Stayokay the full book value.
At all times, Stayokay reserves the right to terminate an agreement without any obligation to pay compensation, if there is sufficient cause to believe that the meeting to be held in the Hostel on the basis of the agreement is of a vastly different nature than would have been expected based on the customer’s request or based on the character of the customer or guests, and that Stayokay would not have entered into the agreement had it known the true nature of the intended meeting. Should Stayokay choose to exercise this right after said meeting has commenced in the Hostel, the customer and guest will be required to pay for the services rendered thus far, but his/her remaining payment obligations lapse. In such a case, compensation for services rendered to that point will be calculated proportionately.
Stayokay reserves the right to impose further conditions with respect to the progression of the meeting concerned. If insufficient guarantees are forthcoming or if there is cause to believe that these conditions will not be met, Stayokay is authorized to act on behalf of the Hostel and terminate the agreement nonetheless.
At all times, Stayokay reserves the right to request the customer to transfer or have transferred to a bank and/or giro account indicated by the Hostel under Stayokay a deposit equal to a maximum of the reservation price minus possible interim payments effected earlier. Deposits received will be properly administered, serving only as surety for Stayokay and will explicitly not constitute already generated turnover.
Stayokay is authorized to settle any amounts due from the customer arising in whatever manner against the deposit received. Stayokay is obligated to immediately reimburse any amounts remaining to the customer.
Stayokay can never be held liable for any damages incurred by the customer, the guest and/or third parties unless such damage results from deliberate actions or gross negligence on the part of Stayokay. This exclusion of liability also applies in particular to damages arising as a result of the consumption of foodstuffs prepared or served by the Hostel and damages arising as a result of computer problems.
Stayokay is not liable for the damage, loss or theft of goods and can therefore not be obligated to pay any form of compensation whatsoever in this context. The aforementioned also applies to goods handed over for safekeeping or goods contained in other goods belonging to the guest, whether or not said goods have been handed over for safekeeping.
The customer and the guest and any people accompanying them are jointly and severally liable for all damages arising for Stayokay and/or any third party now and/or in the future as a direct or indirect result of default (attributable shortcoming), understood in any event to include breaches of the house rules, and/or wrongful acts, committed by the customer and/or the guest and/or any people accompanying them, as well as for all damages cause by any pet and/or any material and/or any matter under their ownership or supervision.
If a reservation is made, the customer is obligated to pay a deposit of 25% of the amount provisionally owing to Stayokay no later than the date specified in the reservation confirmation. The customer is obligated to pay Stayokay the remaining amount due under the provisional account no later than within a month of the arrival date.
If the advance payment expected by Stayokay is not effected on time, Stayokay reserves the right to offer the (conference) space and/or rooms and/or areas and/or services to a third party.
All accounts, including accounts relating to cancellations or no-shows, are due from the customer and/or the guest from the moment they are presented to them in person, or within the period indicated on the account concerned.
If payment is agreed in a form other than in cash, all accounts, irrespective of the amounts owed, must be paid to Stayokay by the customer and/or guest within a period of fourteen (14) days of the invoice date.
All amounts must be paid in euros. Stayokay can never be obligated to accept cheques, credit cards and other similar means of payment and reserves the right to attach further conditions to acceptance of payment using such means of payment. This also applies to other means of payment not mentioned here. Furthermore, banknotes of € 500,- will not be accepted.
Dutch law applies exclusively to all agreements reached. The Uniform Conditions of Stayokay apply to all our reservations.
